Background Only a few studies have been conducted to assess physicians’ knowledge of legal standards. Nevertheless, prior research has demonstrated a dearth of medical law knowledge. Our study explored physicians’ awareness of legal provisions concerning informed consent and confidentiality, which are essential components of the physician-patient relationship of trust. -/- Methods A cross-sectional study assessed attending physicians’ legal knowledge of informed consent and confidentiality regulations. The study was conducted in nine hospitals in Dolj County, Romania. Physicians were given a questionnaire (...) with ten scenarios and instructed to select the response that best reflected their practice. We assessed the responses of physicians who claimed their practice to be entirely legal. Their legal knowledge was evaluated by comparing their answers to applicable laws. We also calculated a score for the physicians who admitted to committing a legal breach. -/- Results Of the 305 respondents, 275 declared they never committed any law violation. However, their median correct answer score was 5.35 ± 1.66 out of 10. The specialty was the strongest predictor of legal knowledge, with emergency physicians rating the lowest and non-surgical physicians scoring the highest. Physicians who worked in both private and public sectors were better knowledgeable about legal issues than those who worked exclusively in the public sector. Results indicate that physicians are aware of the patient’s right to informed consent but lack comprehensive understanding. While most physicians correctly answered simple questions, only a tiny minority identified the correct solution when confronted with ethical dilemmas. The physicians who acknowledged breaching the law, on the other hand, had a slightly higher knowledge score at 5.45 ± 2.18. -/- Conclusion Legal compliance remains relatively low due to insufficient legal awareness. Physicians display limited awareness of legal requirements governing patient autonomy, confidentiality, and access to health data. Law should be taught in all medical schools, including undergraduate programs, to increase physicians’ legal knowledge and compliance. (shrink)

BackgroundAlthough the Covid-19 epidemic challenged existing medical care norms and practices, it was no excuse for unlawful conduct. On the contrary, legal compliance proved essential in fighting the pandemic. Within the European legal framework for the pandemic, patients were still entitled to be treated equally, by a specialized physician, with the possibility of seeking a second medical opinion, in a confidential setting, following prior and informed consent. This study examines physicians’ practices regarding patients’ rights during the Covid-19 pandemic and the (...) effects of age, experience, and specialty on physicians’ behavior and preferences. Additionally, it explores the nexus of malpractice complaints, malpractice fear, and legal compliance.MethodsA cross-sectional study was conducted on a convenience sample of attending physicians and general practitioners to assess compliance with patients’ rights regulations. Respondents were physicians practicing in private and public settings in Southwestern Romania from July 2021 to May 2022.Results396 attending physicians and 109 general practitioners participated in the research. Attending physicians acknowledged patients’ rights in 55.7% of statements, while general practitioners showed a slightly higher level of compliance at 59.9%. Emergency and Anesthesia and Intensive Care physicians showed the lowest compliance. There were no significant behavioral differences based on physicians’ age, years in practice, work sector, or location. However, when faced with the question of prioritizing treatment for patients with similar medical conditions, 46.2% of attending physicians reported favoring the younger patients. This preference was common among physicians under 39. Additionally, over half of the attending physicians reported working outside their area of expertise due to staff shortages. Malpractice fear was high among physicians, although unrelated to patients’ claims, legal compliance, or working outside the scope of practice. It resulted in pressure and behavioral changes.ConclusionAdherence to patients’ rights was low during the Covid-19 pandemic. Physicians could benefit from educational and administrative support to ensure better legal compliance. Further research is needed to determine if this behavior persists beyond the pandemic context. _Reading Proclus and the_ Book of Causes: _Western Scholarly Networks and Debates, Volume 1_ provides a fresh account, based on previously unknown documents, of the diffusion of Hellenic and Islamic thought in the Latin West (12th -16th centuries).

This paper aims to show that Lessing develops in his aesthetics a pre-Kantian philosophy of consciousness. The concept of virtuality that the german writer puts forward in his essay Laocoon implies an interweaving of temporal dimensions similar to the threefold temporal synthesis described by Kant in the transcendental deduction of the Critique of Pure Reason. But whereas Kant thematizes an a priori of consciousness, Lessing is in search of an a priori of plastic art. It will be seen that perfect (...) sculpture presupposes the choice of that moment in time which can open the imagination to the past and the future in a way that enriches the present by transforming it into a "pregnant moment". The final aim of the article is to trace the genesis of the concept of simultaneity of temporal dimensions presupposed by the idea of the pregnant moment, and its implications for the idea of the temporality of consciousness. I take it that the following is a desideratum of our theories in the philosophy of mind. A theory in the philosophy of mind should help us better understand ourselves as agents and aid in our theorizing about the nature of action and agency. In this paper I discuss a strategy adopted by some defenders of nonreductive physicalism in response to the problem of causal exclusion. The strategy, which I refer to as “intralevelism,” relies on treating mental causation as intra (...) level mental to mental causation, rather than as involving any inter level mental to physical causation. I raise problems for intralevelist theories of mental causation that stem from action-theoretic considerations. Specifically, I focus on the failure of intralevelist proposals to account for the problem of basic causal deviance in the etiology of action. To the extent that intralevelism fails to make room for basic causal deviance, the strategy fails to satisfy the aforementioned desideratum, viz ., that our theories in the philosophy of mind should be of use in theorizing about action and agency. The upshot is that intralevelism is a less promising strategy for nonreductive physicalists than it appears at first glance. (shrink)

Recent years have witnessed a search for new sources for archaeological inspiration within areas which until recently have not been imagined as a source for science. Archaeology has become more â oeanthropologizedâ, and, as such, is becoming increasingly influenced by the Zeitgeist, although some European schools are yet to recognize this. The process of scientific research that archaeologists have always considered to be an objective approach has been revealed to be the result of different subjective cognitive processes, forming part of (...) the contemporary humanistic paradigm, a fact confirmed by new tendencies in contemporary archaeology. Consequently, this book considers the question: how does the archaeologist think today? Beginning with simple analogies issued from archaeological experiments or from ethnography, the structure of the contemporary archaeological thought is increasingly complex, working today with concepts that only yesterday were a subject of study. According to the transcendental Aesthetic of the Critique of pure reason, there are two properties of time that cannot be intellectualized: passage and infinitude. This study tries to show that these essential properties of time come to light in Kant’s Critique of Judgment. The contemplation of beauty will be understood as a non-successive time and the wonder that we experience in seeing the sublime will be understood through Kant’s concept of infinite moment. Current developments in fields such as quantum physics, fine arts, robotics, cognitive sciences or defense and security indicate the emergence of creative systems capable of producing new and innovative solutions through combinations of machine learning algorithms. These systems, called machine invention systems, challenge the established invention paradigm in promising the automation of – at least parts of – the innovation process. This paper’s main contribution is twofold. Based on the identified state-of-the-art examples in the above mentioned fields, key components for (...) machine invention systems and their relations are identified, creating a conceptual model as well as proposing a working definition for machine invention systems. The differences and delimitations to other concepts in the field of machine learning and artificial intelligence, such as machine discovery systems are discussed as well. Furthermore, the paper briefly addresses the social and societal implications and limitations that come with the adoption of the technology. Because of their revolutionizing potential, there are widespread implications to consider from ethical and moral implications to policymaking and societal changes, like changes in the job structure. The discussion part approaches some of these implications, as well as solutions to some of the proposed challenges. The paper concludes by discussing some of the systemic benefits that can be accessed through machine invention. (shrink)

Barbaras’ contemporary essay in phenomenological cosmology, L’appartenance, we propose to examine what appear be two internal tensions: a) the apparent inflation of the importance of the conceptuality of spatiality for describing the type of adjointment that unites subjective life and the life of the world, and b) the competition between two opposing ontological models of mobility in the description of subjective life (or of the living in general): a model of.

Cultural schemas are a central cognitive mechanism through which culture affects action. In this article, we develop a theoretical model of cultural schemas that is better able to support empirical work, including inferential, sensitizing, and operational uses. We propose a multilevel framework centered on a high-level definition of cultural schemas that is sufficiently broad to capture its major sociological applications but still sufficiently narrow to identify a set of cognitive phenomena with key functional properties in common: cultural schemas are socially (...) shared representations deployable in automatic cognition. We use this conception to elaborate the main theoretical properties of cultural schemas, and to provide clear criteria that distinguish them from other cultural or cognitive elements. We then propose a series of concrete tests empirical scholarship can use to determine if these properties apply. We also demonstrate how this approach can identify potentially faulty theoretical inferences present in existing work. Moving to a lower level of analysis, we elaborate how cultural schemas can be algorithmically conceptualized in terms of their building blocks. This leads us to recommend improvements to methods for measuring cultural schemas. We conclude by outlining questions for a broader research program. (shrink)

"The “philosophical” style specific to Montaigne’s Essays, totally devoid of demonstration and system, gives the reader the possibility of “essaying” an experience of his own reading, based on the idea that “Words belong half to the speaker, half to the hearer” (III, 13). Following Montaigne’s idea that selfishness is the basis of solidarity between men (the basis of society), we can detect two levels in this political conception: 1) on the one hand, the relationship between the individual subject and his (...) own complex state; 2) on the other hand, the relationship of the individual to otherness. For Montaigne, the first level is a priority and, as his own political experience shows, the individual subject has above all the duty to remain true to himself and to his own temperament. The duty to serve others is secondary, occasional and moderate. To complete the ideas that can constitute a “map” of Montaigne’s political philosophy, we have analyzed – quantitatively and qualitatively – the contexts in which the French philosopher used the word “conflict”. The examples confirm the predominance of the interior level of the individual subject and less of the relationship of the individual to otherness. To be active in the public sphere, the individual needs modesty and moderation in the expression of his opinions, as well as a rational evaluation when he wishes major changes; otherwise, they risk doing more harm than good to others. The individual must struggle internally with the weapons of reason, so as not to give in to irrational desires – such as revenge or carnal desires – which would affect others, which is virtue. An inner balance is necessary, and the others will gain from this. Generic statements (e.g., “Birds lay eggs”) express generalizations about categories. In this paper, we hypothesized that there is a paradoxical asymmetry at the core of generic meaning, such that these sentences have extremely strong implications but require little evidence to be judged true. Four experiments confirmed the hypothesized asymmetry: Participants interpreted novel generics such as “Lorches have purple feathers” as referring to nearly all lorches, but they judged the same novel generics to be true given a wide range of prevalence (...) levels (e.g., even when only 10% or 30% of lorches had purple feathers). A second hypothesis, also confirmed by the results, was that novel generic sentences about dangerous or distinctive properties would be more acceptable than generic sentences that were similar but did not have these connotations. In addition to clarifying important aspects of generics’ meaning, these findings are applicable to a range of real-world processes such as stereotyping and political discourse. (shrink)

In this paper I argue that the values supported by scientists can have a role in episodes of theory choice. In the first part, I characterize the value- and the rulebased accounts of theory choice. In the second part, I analyze how the thesis of underdetermination of theory by empirical data can be used to argue for a value-based account. I discuss two versions of the underdetermination thesis, arguing that the weaker version, underdetermination by the evidence available at a particular (...) time, is sufficient for establishing the role of values in theory selection. Many authors distinguish between cognitive and non-cognitive values, considering that only the former ones have a legitimate role in theory choice. I defend this distinction, showing that it has both a normative and a descriptive dimension. I argue that cognitive values must not be seen as indicators of truth, but they can be characterized by their relation to the goal of science. In the end, I argue that, in spite of being justified and useful, the distinction between cognitive and non-cognitive values is not clear-cut. (shrink)

Father André Scrima emphasised in his works the importance of monasticism as an inward phenomenon of the church, and he even believed that the Orthodox Church can be considered a 'monastic' church, given that monasticism is itself ecclesial. Trying to explain this ecclesial function, Father Scrima developed a unique, fresh vision regarding the role that the monk had throughout history, and this article sought to summarise some of these observations as they emerged from the writings of Father Scrima. CONTRIBUTION: The (...) article focuses on Father Scrima and argues that this remarkable Romanian theologian is often overlooked. He was gifted with an incredible memory and an outstanding capacity to bring together information from different fields of knowledge - the so-called classical culture - with universal cultural elements, patterns, traits or institutions that are common to all human cultures worldwide, presenting them in a theological interpretation. This article proposes a first systematic approach to the manuscript tradition of the Liber de causis. It studies both the manuscript variants and the doctrinal difficulties raised by the transliteration of the Arabic al-ʿaql preserved in the Latin translation. Some authors interpreted this transliteration as a concept forged by Arab philosophers without an equivalent in Latin. Other authors do not mention it because they probably knew a different branch of the manuscript tradition. By examining one hundred and ten Latin manuscripts (...) of the Liber de causis, the article establishes a list of the numerous variations regarding the presence of this transliteration in the text and its forms or spellings. This analysis enables a better understanding of both Albert's position and the hitherto unsuspected diversity of the transmission of the Liber de causis in the Latin West. (shrink)

Pierre Hadot famously claimed that, between Antiquity and German Idealism, Western philosophy had lost its practical role of guiding the life of the practitioner. Scholars who challenged this view focused on two medieval models. This article argues that the overlooked work Colliget principiorum iuris naturalis, divini et humani philosophice doctrinalium by Heymericus de Campo postulates a third model. On the basis of St. Paul’s teaching about the “inner man,” Heymericus reconsiders the Aristotelian doctrines of abstraction and of being as such (...) in relation to the Neoplatonic model of intellectual progression and interior conversion. In a realist conceptual framework, he holds that only metaphysics reflects the true nature of the human being inasmuch as it presupposes a way of life that assumes both the interaction with and withdrawal from the sensible world. However, Heymericus’ theory is neither limited to nor conditioned by Christian principles, but by Peripatetic philosophy. (shrink)

This volume studies the reception of Proclus’ _Elements of Theology_ in Byzantium and the Caucasus, focusing on the composition of the _Book of Causes_ and its translations into Latin and Hebrew. It offers an unique perspective on the acculturations of Proclus to the Abrahamic traditions.

This volume gathers contributions on key concepts elaborated in the Platonic tradition (Proclus, Plotinus, Porphyry or Sallustius) and reconsidered by Arabic (e.g. Avicenna, the _Book of Causes_), Byzantine (e.g. Maximus the Confessor, Ioane Petritsi) and Latin authors (e.g. Albert the Great, Thomas Aquinas etc.).

The volume is dedicated to Berthold of Moosburg’s commentary on Proclus’ _Elements of Theology_. This overlooked work from the 14th century proposed, as an alternative to the prevailing Aristotelian metaphysics, a superior wisdom of the Good articulated within the Platonic tradition, both pagan and Christian.

The contribution by De Dreu and Gross oversimplifies the complexity of the topic. I provide counterarguments that undermine the two sweeping contentions on which the article's argument depends, and I argue that asymmetric conflict is best understood at the finer-grained level of studying the sequences of strikes and counterstrikes that the rival actors have in store for one another.

Even though Pietraszewski acknowledges the tentative nature of the theory and the multiple lines of adjacent research needed to flesh it out, he insists that the finite set of primitives he identified is necessary and sufficient for defining social groups in the context of conflict. In this commentary I expose three interrelated conundrums that cast doubt on this simplistic presumption.

In this paper I argue for the following two related claims. First, the science of phoronomy from Kant's Metaphysical Foundations of Natural Science is grounded in the duplication of space. Second, this duplication is made possible through the self-localization of the subject, as Kant shows in the "Gegnden-Schrift". The thesis of this paper is that the self-localization transforms space into an object that can be cinematically moved and that this action sets the ground for a science of phoronomy, which presupposes (...) the existence of at least two spaces. We propose that human reasoning relies on an inherence heuristic, an implicit cognitive process that leads people to explain observed patterns (e.g., girls wear pink) in terms of the inherent features of their constituents (e.g., pink is an inherently feminine color). We then demonstrate how this proposed heuristic can provide a unified account for a broad set of findings spanning areas of research that might at first appear unrelated (e.g., system justification, nominal realism, is–ought errors in moral reasoning). By revealing (...) the deep commonalities among the diverse phenomena that fall under its scope, our account is able to generate new insights into these phenomena, as well as new empirical predictions. A second main goal of this paper, aside from introducing the inherence heuristic, is to articulate the proposal that the heuristic serves as a foundation for the development of psychological essentialism. More specifically, we propose that essentialism—which is the common belief that natural and social categories are underlain by hidden, causally powerful “essences”—emerges over the first few years of life as an elaboration of the earlier, and more open-ended, intuitions supplied by the inherence heuristic. In the final part of the paper, we distinguish our proposal from competing accounts (e.g., Strevens' K-laws) and clarify the relationship between the inherence heuristic and related cognitive tendencies (e.g., the correspondence bias). In sum, this paper illuminates a basic cognitive process that emerges early in life and is likely to have profound effects on many aspects of human psychology. (shrink)

U ovom clanku bice izlozena polemika o kalam kosmoloskom argumentu, koja je razvijena u srednjovekovnoj islamskoj teologiji i filozofiji. Glavni momenti ove polemike bili su izlozeni stolecima pre u Filoponovoj kritici Aristotelove teze da je svet vecan i da nije moguca aktuelna beskonacnost. Filopon prihvata tezu da je aktuelna beskonacnost nemoguca, ali on misli da, upravo zbog toga, svet ne moze biti vecan. Naime, prema Filoponu, nesto ne moze da nastane ako njegovo po?stojanje zahteva prethodno postojanje beskonacnog broja drugih stvari, (...) od kojih jedna dolazi posle druge. Filopon i njegovi sledbenici u srednjevekovnoj islamskoj teologiji, zvani kalam teolozi, ponudili su argumente protiv koncepcije temporalno beskonacnog univerzuma, koji bi bio shvacen kao sukcesivni kauzalni lanac. S druge strane, srednjovekovni islamski mislioci, zvani falasifah /filozofi/ ili aristotelijanci ponudili su argumente u prilog Aristotelove koncepcije vecnosti univerzuma. Odlucujuci problem u raspravi izmedju kalam i falsafa srednjovekovnih muslimanskih mislilaca bio je problem beskonacnosti. U ovom clanku bice prikazani neki od krucijalnih momenata tih argumenata. Mainstream political liberals hold that state coercion is legitimate only if it is justified on the grounds of reasons that all may reasonably be expected to accept. Critics argue that this public justification principle is self-defeating, because it depends on moral justifications that not all may reasonably be expected to accept. To rebut the self-defeat objection, I elaborate on the following disjunction: one either agrees or disagrees that it is wrong to impose one’s morality on others by the coercive power (...) of the state. Those who disagree reject PJP, they understand politics as war. Those who agree accept PJP, they understand politics as competition. Political competitors abide by PJP to avoid politics as war, by enforcing PJP on political combatants they engage in a war that is unavoidable. In both cases their exercise of political power has a justification that is reasonably acceptable to all. (shrink)

Some philosophers working on the metaphysics of agency argue that if agency is understood in terms of settling the truth of some matters, then the power required for the exercise of intentional agency is an irreducible two-way power to either make it true that p or not-p. In this paper, the focus is on two-way powers in decision-making. Two problems are raised for theories of decision-making that are ontologically committed to irreducible two-way powers. First, recent accounts lack an adequate framework (...) for explaining decisions by the reasons of agents. Second, accepting ontologically irreducible two-way powers into one’s metaphysic of agency implies an ontological commitment to substance dualism. An ontologically less-costly alternative to irreducible two-way powers is offered. It is argued that a reductive account of two-way powers in terms of what George Molnar called “derivative powers” should be accepted. The reductive account can provide us with the truthmakers for talk about two-way powers. Moreover, the reductive account does not share the liabilities of accepting irreducible two-way powers. This Element focuses on some core conceptual and ontological issues related to pantheistic conceptions of God by engaging with recent work in analytic philosophy of religion on this topic. The conceptual and ontological commitments of pantheism are contrasted with those of other conceptions of God. The concept of God assumed by pantheism is clarified and the question about what type of unity the universe must exhibit in order to be identical with God receives the most attention. It is argued that (...) the sort of unity the universe must display is the sort of unity characteristic of conscious cognitive systems. Some alternative ontological frameworks for grounding such cognitive unity are considered. Further, the question of whether God can be understood as personal on pantheism is explored. (shrink)

The standard liberal egalitarian approach to religious exemptions from generally applicable laws implies that such exemptions may be necessary in the name of equal respect for each citizen’s conscience. In each particular case this approach requires balancing the claims of devout believers against the countervailing claims of other citizens. I contend, firstly, that under the conditions of deep moral and ideological disagreement the balancing procedure proves to be extremely inconclusive. It does not provide an unequivocal solution even in the imaginary (...) case based on the biblical story of Abraham’s sacrifice, not to speak of real-life cases that are far less suggestive. Secondly, I argue that it is possible to consider demands for religious exemptions respectfully, without even challenging the way they are justified, but still reject them for principled reasons—namely, because these demands cannot be met without arbitrarily bending popular sovereignty to the dictate of religious doctrines.
